11. Use of GISED website
1.1 GISED grant applicant account is provided for use by voluntary and community organisations (whether or not a registered charity) carrying out charitable activities (s), subject to these Terms and Conditions. By registering for a GISED account account you agree to be bound by these Terms and Conditions. “You” refers to being a company, partnership or any unincorporated organisation acting by its management committee.
22. Registration
2.1 You must ensure that the details provided by you on registration or at any time are correct and complete. We are not liable under any circumstances for any inaccurate or incorrect data entered on your end.
2.2 You must notify us immediately of any changes to the information that you provided when registering by updating your contact details.
2.3 You must ensure the content of your account reflects your company information and remains up to date and complete and accurate in all material respects. The information you provide on your account may be used by GISED to influence their decisions whether or not to make a grant to you.
2.4 It is entirely your responsibility and you must ensure it is truthful, decent, honest and legal. If you use any copyright material, you must ensure you have the consent of the copyright owner to use such material. If your photos include children or vulnerable adults, you must have the appropriate permissions in writing for such material to be used. Your submission of such information constitutes a warranty that you have complied with the provisions of this clause 2.3 and that we are authorised to publish such material.
2.5 By notification to [email address], you may, at any time, request your grant information be taken offline by us. You may also request that all your details be deleted from our databases. We undertake to comply with such requests within a reasonable period of time.
33. Donations and fees
3.1 Registration and access to GISED website including your account and page is free.
3.2 Registration with the GISED website of your details does not guarantee that we will approve your grant application. GISED will have absolute discretion as to whether or not it makes the grant to you.
3.3 To the extent grant donations are made to you by GISED, you undertake they will only be used in accordance as per your grant application. If requested by GISED, you agree to provide reasonable details of how the funds given were used by submitting an emailed report to [email address].
3.4 GISED distributes its grant funds by BACS transfer, except where a fundraising team specifically requests payment by cheque to their specified recipient organisation. Cheques that are not cashed by the recipient organisation within six months of being issued will be cancelled and forfeited. Cancelled cheques will not be re-issued.
44. Password and security
4.1 When you register an account on the GISED website, you will need to input a password. In order to prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password, you should notify us by contacting [email address] as soon as possible.
4.2 If GISED has reason to believe that there is likely to be a breach of security or misuse of the GISED website or your account, you may be required to change your password or we may suspend your account.
55. Intellectual property
5.1 Apart from your content on your grant application that you may use for any purpose you wish, the other content of GISED website (including accounts of others) is protected by copyright, trade marks, database right and other intellectual property rights. You may retrieve and display the other content of GISED website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You are not permitted to reproduce, modify, copy or distribute or use for commercial purposes any of the other materials or content on the GISED website without obtaining written consent from us.
66. Your use of the GISED website
6.1.1 disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;
6.1.2 transmitting material encouraging conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or code of practice;
6.1.3 interfering with any other person's use of the GISED website; or
6.1.4making, transmitting or storing electronic copies of materials protected by others' copyright without the permission of the owner.
6.2 You will be responsible for our losses and costs resulting from your breach of this clause 6.
77. Availability of GISED website
7.1 While we intend to offer you the best service possible, we cannot guarantee that our services will be fault-free. If a fault occurs with GISED website or your page, you should report it to [email address] and we will correct it as soon as we reasonably can.
7.2 Your access to the GISED website may be restricted from time to time in the event of repairs, maintenance or the introduction of new facilities or services. We will restore the service as soon as we reasonably can.
88. GISED 's right to suspend or cancel your registration
8.1 We reserve the right to suspend or cancel your registration immediately at our reasonable discretion or if you breach or violate any of your obligations under these Terms and Conditions, specifically the conditions set out at clauses 3.3 and 6.
8.2 You can cancel your registration at any time by informing us in writing at [email address]. If you do so, you must stop using the GISED account created by you.
8.3 The suspension or cancellation of your registration and your right to use GISED website shall not affect either party's statutory rights or liabilities.
99. GISED’s liability
9.1 The GISED website may reference content from other internet sites or resources, and while we work to ensure that material included is correct, accurate and of high quality, it does not make any warranties or guarantees related to that content. If GISED is informed of any discrepancies in the material on the site we will attempt to correct them as soon as possible.
9.2 If we are in breach of these Terms & Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you use the GISED site. Our liability shall not in any event include business losses such as lost data, loss of profits or business interruption.9.2 This clause 9 shall not limit or affect our liability resulting from something we do negligently which causes death or personal injury.
1010. Amendments
10.1 We may update these Terms and Conditions occasionally for legal or regulatory reasons or to allow the proper operation of the GISED website at our discretion. If you do not wish to accept the new Terms and Conditions you should not continue to use the GISED website. If you continue to use GISED website after the date on which the change comes into effect, your use of GISED website indicates your agreement to comply with the new Terms and Conditions.
1111. Third party websites
11.1 GISED website includes links to other websites or material which are beyond its control. GISED is not responsible for content on any site outside the GISED website.
11.2 You hereby authorise and licence us to utilise the data contained in your account. Our authority under this clause shall immediately cease in the event you notify us at [email address].
1212. Applicable law
12.1 These Terms and Conditions will be subject to the laws of Europe. We will try to solve any disagreements quickly and efficiently. If you are not satisfied with the way we approach any disagreement and you want to take court proceedings, you must do so within Europe.
1313. Miscellaneous
13.1 You are not to transfer any of your rights under these Terms and Conditions to any other person or organisation.
13.2 If you breach or violate these Terms and Conditions and the Company chooses to ignore this, GISED will still be entitled to use its rights and solutions at a later date or in any other circumstance where you have breached the Terms and Conditions.
13.3 GISED shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
